Munchers Online Terms and Conditions

Munchers.online is an online ordering platform created by Munchers Online; ABN: 72 127 224 143 (“we”, “us” or “our”). We partner with food businesses (“Restaurant”) to provide information and ordering services regarding products offered by the Restaurant. Munchers and the Restaurant agree to uphold Australian Consumer Law.

1. Modifications
   We reserve the right to modify these Terms and Conditions or any policies related to munchers.online at any time, effective upon posting an updated version of these Terms and Conditions on munchers.online.
2. Refunds
   We will provide a refund if you and the Restaurant agree that one should be provided. In the case of a dispute we reserve the right to withhold any refund to the fullest extent permitted by the law. Refund requests must be made within three days of the order’s collection date. Refunds may be refused in instances where you break these terms and conditions
3. Guarantee
   The Restaurant takes steps to maintain the accuracy of the information contained on munchers.online. However, errors may sometimes occur. Therefore, to the fullest extent permissible pursuant to the applicable law, Munchers and the Restaurant make no guarantees about the reliability of the features or the content on munchers.online, including the accuracy of images and the availability of menu items, or other products. You acknowledge that any reliance on such material and/or systems will be at your own risk.
4. Limitation of Liability
   The Restaurant is responsible for providing the product(s) you purchase and for any issues with it(them). If you find any issue with the product(s) or service from the Restaurant you will not hold us liable for those issues.
5. Privacy
   You agree to the privacy policy found at munchers.online.
6. Online Payment
   To process payments on munchers.online we use Commonwealth Banks payment gateway. As such any payment card and billing information will be given to them for processing. You agree to pay the price and have your payment card billed for the total amount displayed at checkout at the time of your order.
7. Collection
   You agree to collect your order from the Restaurants store location within a reasonable amount of time from payment or other agreed upon time and within the Restaurants operating hours. The Restaurant reserves the right to withhold and destroy any product whose quality has been compromised as a result of delayed pick-up (especially in regards to food safety).
8. Rules and Prohibitions
   By using munchers.online you agree that:
   1. You will only use it for lawful purposes.
   2. You will not engage in conduct that harms the Restaurant or Munchers or their employees or other users.
   3. You will not impersonate any person or entity, or forge or manipulate headers or identifiers to disguise the origin of any content transmitted through munchers.online.
   4. You will not use the munchers.online to cause nuisance, annoyance or inconvenience.
   5. You will not copy or distribute any content displayed on munchers.online, including our menu content, for republication in any format or media.
   6. You will not deep-link to munchers.online or access our site manually or with any robot, spider, web crawler, extraction software, automated process and/or device to scrape, copy, index, frame, or monitor any portion of our site or any content on our site.
